1. Acceptance of Terms
By accessing or using Mytho ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Mytho is an independent third-party e-commerce platform that enables users to add shopping functionality to their Ghost® CMS websites. Mytho is not affiliated with, endorsed by, or sponsored by Ghost Foundation. Ghost® is a registered trademark of Ghost Foundation.
The Service includes:
- Product management and inventory tracking
- Payment processing through Stripe
- Order management and fulfillment tools
- Shipping configuration and calculation
- Discount code management
- Email notification capabilities
3. Account Registration
To use the Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Be at least 18 years old or the age of majority in your jurisdiction
- Comply with all applicable laws and regulations
You are responsible for all activities that occur under your account.
4. Subscription and Payment
4.1 Pricing
Mytho Cloud subscription is $15 USD per month. Pricing is subject to change with 30 days notice.
4.2 Free Trial
New accounts receive a 7-day free trial. No credit card is required to start the trial. After the trial period, you will be charged the monthly subscription fee unless you cancel.
4.3 Payment Processing
All subscription payments are processed through Stripe. By subscribing, you agree to Stripe's Terms of Service. We do not store your payment card information.
4.4 Refunds
Subscription fees are non-refundable. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.
4.5 Transaction Fees
Mytho does not charge transaction fees on your sales. You are responsible for Stripe's payment processing fees, which are set by Stripe.
5. Stripe Connect
To accept payments from customers, you must connect a Stripe account. By connecting your Stripe account, you agree to:
- Stripe's Services Agreement and Connected Account Agreement
- Comply with all applicable payment regulations
- Provide accurate business information to Stripe
- Handle customer disputes and chargebacks responsibly
Mytho is not responsible for any issues arising from your Stripe account, including payment disputes, holds, or account suspensions.
6. User Responsibilities
You agree to:
- Accurately represent products and services you sell
- Fulfill orders promptly and professionally
- Comply with all applicable consumer protection laws
- Handle customer data in accordance with privacy laws (GDPR, CCPA, etc.)
- Not sell illegal, counterfeit, or prohibited items
- Not use the Service for fraudulent purposes
- Not violate intellectual property rights of others
- Not abuse or overload our systems
7. Prohibited Activities
You may not use Mytho to:
- Sell illegal goods or services
- Sell counterfeit or stolen products
- Engage in fraudulent activities
- Violate any laws or regulations
- Infringe on intellectual property rights
- Harass, threaten, or abuse others
- Distribute malware or harmful code
- Interfere with the Service's operation
8. Intellectual Property
8.1 Mytho Ownership
Mytho and its original content, features, and functionality are owned by Mytho and are protected by international copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain all rights to the content you upload to Mytho (product descriptions, images, etc.). By uploading content, you grant Mytho a license to use, store, and display your content solely for the purpose of providing the Service.
8.3 Third-Party Trademarks
Ghost® is a registered trademark of Ghost Foundation. Mytho is an independent tool and is not affiliated with Ghost Foundation.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using Mytho, you consent to the collection and use of your data as described in the Privacy Policy.
10. Service Availability
We strive to maintain high availability, but we do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance, updates, or modifications at any time, which may temporarily disrupt service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Mytho SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL Mytho'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO Mytho IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Mytho and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Products or services you sell through the Service
13. Termination
13.1 By You
You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Upon cancellation, you will retain access until the end of your current billing period.
13.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- Your account is used for fraudulent purposes
- Payment fails and remains unpaid
- We are required to do so by law
Upon termination, your access to the Service will cease immediately.
14. Data Retention After Termination
After termination:
- Your shop embed will stop displaying products
- We retain your data for 90 days to allow reactivation
- After 90 days, your data may be permanently deleted
- You may request immediate data deletion by contacting us
15. Changes to Terms
We may modify these Terms at any time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
16. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved in the courts of England and Wales.
17. Dispute Resolution
In the event of a dispute, you agree to first contact us at [email protected] to attempt to resolve the issue informally before pursuing legal action.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mytho regarding the Service.
